At MSC, we help to find solutions for conflicts:

The mediation process begins with a snapshot view of:

·         Understanding why there is a conflict and how developed it is,

·         Relevant to conflict laws, documents and regulations.

Cases can often be settled in a few hours over a single session, but some take more time. Usually, people don’t have malicious intents toward each other, but simply unaware how system works and what is available to them.

MSC knows that when a nature of a conflict is clear and available tools/laws are visible, all parties involved are willing to resolve conflict in order to avoid further costs, lawyers and courts.

Below are three examples of cases which lawyers didn’t want to take, but MSC resolved:

 

1.      An income property fire: owner vs. insurance and hired by the insurance contractors

Insurance’s chosen contractors got paid, but didn’t finish a work, so process stalled with more damage than before (due to vandalism and theft). Owner simply wanted an X amount of money for repairs, couldn’t get it and was ready to abandon the property which would cause further financial hardship, bad credit, etc...

MSC results: owner got a few times more the amount he wanted for restoration and loss of use.

 

2.      Truck repairs: owner vs. leased company, insurance and repair shop.

Leased commercial truck broke on highway and was repaired by a local repair shop with insurance on parts/repairs, but broke again two weeks later some 3,000 miles away from the repair shop. Leased company took the truck and wanted $15,000 for repairs while insurance for parts/repairs wanted to access truck i.e. tow it back to the repair shop at owner’s expense. It appears that everyone had legitimate reasons not to act and demand something from the owner. At the same time the owner was not making any income, was ready to abandon the truck and was on a verge of bankruptcy with all negative consequences of such action.

MSC results: the repair shop gave the owner a commercial truck for $1.00 (one dollar) a month to make an income, leased company sent parts/estimate to repair shop and the repair shop (with MSC help) worked with its insurance to cover all cost.

 

3.      Demand back and denial of benefits: beneficiary vs. government

Government discovered that a beneficiary owns a house and; therefore, denied benefits and demanded back paid benefits. The beneficiary didn’t know/misunderstood that few years back real estate and loan agents placed her as a cosigner on a house and an additional loan; therefore, legally she owned a house which she never paid for and didn’t use.

MSC results: helped all parties involved to clarify issues and created appropriate contracts to make reality clear. Currently, retiree receives her benefits.

 

4.      Overcharges: renter vs. apartment complex, utilities

Renter suspected that he was overcharged, but apartment complex and utilities insisted that everything was fine while denying that they have control over the issue by pointing at each other.

MSC results: utility discovered that renter was charged for someone’s bills and refunded overcharged money while apartment complex gave one month free rent with an apology.
